The Canadian Association of Paralegals (“CAP”, “we”, “our”) is committed to taking the necessary measures to respect the principles and requirements for the protection of privacy and personal information under the applicable legislation in this area. This Personal Information Protection Policy (the “Policy”) applies to the services offered by CAP, its subsidiaries and affiliates under the domain https://caplegal.ca (the “Site”).

Your privacy is our main concern. Our goal is to ensure the confidentiality and security of the personal information you provide to us and to protect that information in accordance with applicable privacy laws. This Policy explains our privacy and security practices. In this Policy, personal information means information that can identify an individual, directly or indirectly.

Personal information collected and purposes

In the course of our business, we may collect personal information from you. We only collect personal information that is necessary to provide you with our various services. Where possible, we indicate both mandatory and optional fields. Collection directly from you We collect personal information about you, primarily in the following situations:

  • When you contact us (by email, telephone, mail or in person), we may collect your name, email address, address, telephone number, and the company you work for. This information allows us to provide the requested information, products or services and communicate with you regarding your contact request;
  • When you join CAP as a member or renew your membership status, we collect the information necessary to complete your profile and pay the fees associated with your registration or renewal. This information may include your name, contact details, place of employment, etc. We do not directly collect your credit card information, which is collected by a third party service provider.
  • When you subscribe to our newsletter or register for a promotional activity, we will collect your name and email address in order to send you promotional emails about our activities and promotions that may be of interest to you. You can choose to modify your preferences by following the “Access their profile” link or unsubscribe by following the “Unsubscribe” link in an email or communication received; 
  • When you respond to a survey launched by CAP, we use the information collected to better understand how to improve our activities and services, develop and direct our activities and operations, as well as achieve other internal objectives;
  • If you apply for a volunteer or administrator position, we will collect your name, email address, and any other information you provide to us, including your employment history. We use this information to evaluate and respond to your application.

Generally, personal information about you will be collected directly from you. However, we may collect personal information from third parties, to the extent permitted by law. We may also collect personal information to comply with applicable legal and regulatory requirements, or for other purposes permitted by law.

We do not collect personal information for any other purpose unless we obtain the consent of the individual concerned.

How is your personal information used or disclosed?

We only use or disclose personal information to the extent reasonably necessary to facilitate the purposes listed above. We may share your information with our affiliates when necessary to achieve these purposes.

Retention of your personal information

We will maintain the confidentiality of your information and it will only be used in accordance with this Policy or applicable laws. Our internal practices help protect your privacy by limiting employee access and use of customer data.

We have implemented reasonable security measures to protect against the theft, loss, misuse or alteration of your personal information, such as the implementation of firewalls and encryption technologies, as well as the restricting access to personal information to only those employees who actually need it. However, it is important to note that any information transmitted over the internet can be intercepted by a third party. Consequently, we could not and would not assume liability in the event of theft, loss, misuse or alteration of any personal information transmitted via the internet.

The safety and security of your information is also your responsibility. If you have chosen a password to access certain elements of the Site, you are responsible for protecting this password. We ask that you do not share your password with anyone else.

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, or for legal or business purposes. When your personal information is no longer required, we destroy or anonymize your personal information (that is, we modify the information so that it does not identify, directly or indirectly, a specific individual or allow it to be traced, irreversibly) in order to use it subsequently, in accordance with applicable laws.

Hosting and transfers of personal information

We will store personal information on our internal servers or with service providers. Personal information collected about you may be stored and/or processed outside of the jurisdiction in which you reside. Our service providers may store and process personal information outside of your province of residence or Canada. Where information is stored or processed outside of your jurisdiction, it may be subject to and accessible to law enforcement authorities in those other jurisdictions. We have taken appropriate technical, organizational and legal measures to secure this information. We ensure that our service providers comply with all applicable privacy laws and implement contractual clauses imposing obligations on them. Our website may contain links to other third party websites that may collect personal information. This policy does not include the privacy practices of these third parties (or lack thereof). We cannot and do not assume responsibility for the policies, practices and actions of these third parties.

What are your rights?

By providing us with your personal information and/or using our products or services, you consent to the collection, use and disclosure of your personal information by CAP.

You have the right to view, verify, modify and correct your personal information collected by us. To consult, verify, correct or update your personal information, we invite you to contact our personal information protection officer using the contact details provided at the end of this Policy.

Before giving you access to your information, providing you with the personal information we hold about you, or to make requested changes, we may ask you for information to help us confirm your identity and your right to access this information.

In certain cases, applicable laws may require us to refuse to provide you with access to some or all of the personal information that we hold about you, or that we may have destroyed, erased or anonymized in accordance with our legal obligations to do so.

Retention of records and best practices in the protection of personal information. We may not accept a request to change information if we believe that the change would violate a law or legal requirement or result in incorrect information in our records.

You may refuse or withdraw your consent to the collection, use and disclosure of your personal information, or request deletion of the personal information we hold about you, at any time upon reasonable notice, subject to any legal or contractual requirements. However, if consent is withheld or withdrawn, we may not be able to provide certain products or services. We will explain the consequences of deleting your information or withdrawing your consent once we receive your request to help you make your decision.

Effective date and modification

This policy, as amended from time to time, was adopted by CAP as of the last update date indicated above. We reserve the right to modify this policy at any time. If we intend to use or disclose personal information for purposes materially different from those described in this Policy, we will make reasonable efforts to notify you, including by posting the revised Policy on our Site. By continuing to provide personal information or use our site after any changes to this Policy, you accept those changes.
